Harker Heights Personal Injury Lawyer for I-14 Crashes, Store Falls, and Lake Injuries
Harker Heights has one main road, a busy shopping district beside it, and a lake just outside the city limits. Injuries happen in all three places, and each follows different rules. If a careless driver, a store owner, or a bar hurt you, a Harker Heights personal injury lawyer can tell you who owes you, how much, and by what date. Michalk, Beatty & Alcozer, L.P. represents injured people from our Killeen office, a short drive west on the same highway. This page covers the roads, the stores, the parks, and the courts. To see how we handle injury cases in the towns around you, read about our Central Texas personal injury practice.
A Harker Heights Personal Injury Lawyer for a Town Built Around One Highway
Almost everything in Harker Heights sits along the Central Texas Expressway, which is also I-14. Congress approved the interstate name for the old US 190 in 2015, and Texas finalized the 25-mile stretch from Copperas Cove to Belton in January 2017. Interstate traffic now shares the road with people making short local trips, and the two don't always mix well.
That mix is why a short trip to the grocery store can end in a serious wreck. You can recover medical bills, lost pay, and pain when another person's carelessness causes your injury. Our job is to find every person and company that shares the blame and every insurance policy that can pay.
FM 2410 and the Expressway: Where the City's Crashes Cluster
Harker Heights police counted crashes by intersection for 2021, and the Killeen Daily Herald published the top five:
FM 2410 and the Central Texas Expressway: 18 crashes
Stillhouse Lake Road and Chaparral Road: 8
Edwards Drive and Lookout Ridge Boulevard: 8
South Roy Reynolds Drive and FM 2410: 7
Indian Trail and the Central Texas Expressway: 6
Those numbers show a pattern. Two of the five sit on FM 2410, and two sit where a side road meets the expressway. Crashes at signals usually come down to one question: who had the green? We chase the answer through the signal timing records, any camera footage from nearby businesses, and the 911 audio, because much of that evidence gets erased within weeks.
Rebuilding FM 2410 Added Work-Zone Crashes
TxDOT began rebuilding and widening FM 2410 in fall 2023, from Stillhouse Lake Road to Simmons Road near Nolanville. Crews closed lanes during the day and ran flaggers and pilot cars, which means drivers faced sudden stops and merges.
A work-zone crash can involve more than two drivers. The road contractor may owe a duty to set up cones, signs, and lane shifts correctly. A contractor that followed the state's plans exactly can raise a defense, so we ask for the traffic-control plan and the daily work logs before anyone's memory fades. If you were hurt near a construction zone on FM 2410 or I-14, take photos of the signs and barrels as soon as you can. Then read about our car accident lawyers and call us.
Three Calls to Make From the Roadside
First, call 911 and ask for medical help, even if you feel fine. Adrenaline hides injuries, and a neck or back problem may not show up for a day or two. Texas law requires a driver in a crash with injuries to stop and give reasonable help (Transportation Code § 550.021), and a driver who leaves faces criminal charges.
Second, get the Harker Heights Police Department to the scene if you're inside the city. The department sits at 402 Indian Trail Drive, and its records line is 254-953-5404. Incident reports go through a Public Information Act request, and the official Texas crash report comes through TxDOT's online system. Read the report for errors in the diagram, the insurance information, and who said what.
Third, photograph everything: vehicles, skid marks, signals, your injuries, and the other driver's plate and insurance card. Don't give the other driver's insurer a recorded statement until you've spoken with a lawyer.
Seton, ClearSky, and the Road Back
The hospital closest to most Harker Heights crashes is Seton Medical Center Harker Heights, an 83-bed hospital at 850 West Central Texas Expressway. The hospital describes its emergency room as Level IV trauma-designated. Patients with the worst injuries often move to Baylor Scott & White Medical Center in Temple, which holds the state's top Level I designation.
Recovery doesn't end at discharge. ClearSky Rehabilitation Hospital of Harker Heights, a 30-bed hospital on the same road, treats strokes, brain injuries, hip fractures, and spinal injuries. A long rehab stay changes what a claim is worth, because future therapy, equipment, and lost earning years count as damages. We ask your doctors to put your long-term needs in writing.
Texas also lets a hospital file a lien on your injury case. If you were admitted within 72 hours of the accident, the hospital can file notice with the Bell County Clerk and claim payment from your settlement (Property Code § 55.002). We check each lien against the bills and negotiate it down where the law allows.
Slips and Falls Along the Shopping Corridor
Harker Heights draws shoppers from a wide area to Market Heights, at I-14 and FM 2410, and to the stores and restaurants that line the expressway. Wet floors, loose mats, cracked parking lots, and dark stairways cause injuries every day.
Texas makes a store's duty narrower than most people expect. Under the Texas Supreme Court's decision in Keetch v. Kroger, you must show the owner knew or should have known about the hazard and didn't fix or warn about it. That makes time the key piece of evidence. We send a preservation letter right away so the store keeps its surveillance video, cleaning logs, and incident report. Learn more about premises liability claims before you talk to a store's adjuster.
When a Bar or Restaurant Serves a Driver Too Much
Restaurants and bars cluster along the same roads where crashes cluster. Texas holds a business that sells alcohol responsible for a crash when it served a customer who was obviously intoxicated and a clear danger to others, and that intoxication caused the crash (Alcoholic Beverage Code § 2.02).
The claim is separate from the claim against the drunk driver, and it can matter when that driver has little insurance. Receipts, card statements, and witness names from the drinker's night out all help. We move quickly to find them, since a bar's records and cameras don't last.
Carl Levin Park and Claims Against the City
Harker Heights runs Carl Levin Park at 307 Miller's Crossing, with a seasonal pool, pavilions, gazebos, an amphitheater, and the recreation center. A fall on a broken step or a pool injury feels like an ordinary premises case, but a city is not an ordinary defendant.
Texas protects cities under its Tort Claims Act. You must give the city written notice of your claim within six months (Civil Practice and Remedies Code § 101.101). A city's liability for one person's injuries is capped at $250,000, with $500,000 for a single event (§ 101.023). A free park visit can also trigger the state's recreational-use rules, which in many cases require you to prove gross negligence, not just carelessness (§ 101.058 and Chapter 75). City vehicles and equipment follow a different, more favorable rule. Because those lines are fine ones, bring us any injury on city property before the six months run out.
Dana Peak Park, Stillhouse Hollow Lake, and Federal Claims
The Army Corps of Engineers built Stillhouse Hollow Lake in 1968 and maintains Dana Peak Park, about 560 acres reached from Comanche Gap Road at FM 2410, according to the city of Harker Heights. The park has boat ramps, trails, a beach, and campsites.
Federal land means federal rules. A claim over a dangerous ramp, a rotted dock, or an unmarked hazard goes against the United States under the Federal Tort Claims Act. You must present a written claim to the agency within two years (28 U.S.C. § 2401(b)), and if it denies you, you have six months to sue. A federal judge, not a jury, decides the case. Boating crashes on the lake follow Texas negligence rules and the usual two-year clock. We help you sort out which path fits.

Fault, Insurance Limits, and Why Adjusters Ask About Speed
Texas follows a 51 percent bar. If a jury decides you were more than 50 percent responsible, you recover nothing (Civil Practice and Remedies Code § 33.001). A jury that finds you 20 percent at fault cuts your award by one fifth. That's why adjusters ask early whether you were speeding, looking at your phone, or in a hurry.
Insurance limits set the real ceiling. Texas requires drivers to carry only $30,000 per injured person, $60,000 per crash, and $25,000 for property damage (Transportation Code § 601.072). If three people are hurt, they share one $60,000 pot. Look at your own policy for uninsured and underinsured motorist coverage, which Texas insurers must offer, and for personal injury protection, which pays medical bills up to the limit you chose regardless of fault.
Motorcycles and Pedestrians Take the Worst of It
Riders and walkers have no steel frame around them, so a low-speed crash can cause a broken pelvis or a brain injury. Texas lets riders 21 and older go without a helmet if they finished a safety course or carry enough medical coverage (Transportation Code § 661.003). Insurers still try to blame a rider for any injury, with or without a helmet.
Drivers must yield to people in a crosswalk, and turning drivers often miss a rider or walker who is in plain view. Ask whether the driver was texting, whether a headlight or sign blocked the view, and whether a business camera caught the moment. Those answers decide who pays.
Deadlines That End a Harker Heights Injury Claim
Each defendant sets a different clock:
A driver, business, or bar: two years from the injury to file suit (Civil Practice and Remedies Code § 16.003).
The city, the county, or a state agency: written notice within six months.
The federal government: a written claim within two years, then suit within six months of a denial.
A child's injury: the two years generally start on the child's 18th birthday (§ 16.001), but the parents' claim for medical bills runs sooner.
Don't wait for the deadline. Witnesses forget, video disappears, and your treatment records are easier to gather while you're still seeing the doctor.
Wrongful Death After a Harker Heights Crash
When someone dies because of another person's act, Texas lets the surviving spouse, children, and parents bring a wrongful death claim. The estate can bring a separate survival claim for the pain and expense before death. If the family doesn't act within three months, the executor may have to file unless every family member objects (Civil Practice and Remedies Code § 71.004).
An executor has to be appointed through Bell County probate before the survival claim moves, so the two cases need to run together. Our wrongful death attorneys work with our probate attorney, Jay Beatty, so neither file waits on the other.
Tickets, Small Claims, and Where Your Case Is Filed
If the officer gave you a ticket, call us before you answer it. Harker Heights Municipal Court, at 305 Miller's Crossing, hears traffic tickets. A guilty plea can later be used against you in your injury case, while a no contest plea can't (Code of Criminal Procedure art. 27.02).
A property damage dispute worth $20,000 or less can go to a Bell County justice court, and this area falls in Precinct 4 at the Killeen Annex, 301 Priest Drive. Serious injury cases go to the district courts at the Bell County Justice Center, 1201 Huey Road in Belton. A Harker Heights personal injury lawyer can tell you which court fits and file there.
How Our Harker Heights Personal Injury Lawyer Team Works Your Case
Four of our attorneys take injury cases, and each one brings something to a Harker Heights claim.
Glenn W. Michalk, licensed in Texas since 1970, was Killeen's city attorney and an assistant district attorney in Bell County. He knows how local agencies and courts work from the inside.
Manuel Alcozer spent six years as a hospital respiratory therapist before law school, so he reads your medical records with a clinician's eye.
Jay R. Beatty worked as a project engineer and project manager on office buildings, hospitals, and hotels before he became a lawyer. He reads site plans and work-zone drawings that other lawyers set aside.
Robert "Alex" Bass graduated from the University of Oklahoma College of Law magna cum laude in 2009. He also handles construction and commercial disputes, which helps when a case involves a contractor or a business owner.
